Terms & Conditions

Lead Time: All of Beechlawn Furniture Ltd sales are special orders: - furniture ordered specially for you from the factory. The lead time quoted is an estimate based on past experience. We will endeavour to deliver the Products to you within this time/day of your Account order within mainland UK. Beechlawn Furniture Ltd cannot be held responsible for manufacturer delays. Beechlawn Furniture Ltd will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those Products. At the time of delivery you will be required to validly sign-off on the delivery of the Products, after which time the Products become your sole responsibility.

Delivery: Beechlawn Furniture Ltd offer delivery to the room of your choice by our appointed agent, they will transport your furniture directly to your home in there specially equipped furniture vans with specially trained staff and set the furniture in place in your home. There is no additional charge for this service. Deliveries normally take 3-4 weeks. Orders must be arranged for delivery within 14 days of us contacting you. A re-delivery charge will be imposed if no one is home to accept delivery and a 15% storage charge will be applied per month or part thereof unless otherwise agreed in writing at the time of purchase.

In exceptional circumstances, a product may arrive suffering minor wear and tear from the shipping process, or even a minor defect that occurred at the factory. Please note that you must report any damage immediately upon delivery by noting it on the Delivery Collection Note and emailing us on service@beechlawnfurniture.com or calling +44 (0)28 9030 0563

Please note the size and dimensions of the merchandise you have ordered and ensure that the item of furniture will fit in the designated room and through any passages, stairwells, landings and doorways on the way to the destination room. Beechlawn Furniture Ltd does not accept responsibility for any furniture that will not fit into its intended location.

Generally, where an order contains more than one item all items will be delivered at the same time once all items are available.

Cancellation: Will not be accepted once goods have been reserved, stored, cut or despatched by our selves, or by our suppliers. If you need to return your purchase to us for any reason, the goods must be securely and adequately wrapped for transport in their original packaging and unused as couriers may refuse to collect. If the goods are not available for collection or not adequately packed we reserve the right to charge a failed collection cost of £25. All goods are inspected on return. We will only pay the costs of return if agreed beforehand.

Please note that for selected items of leather upholstery there is a 50% cancellation/returns fee unless the order is cancelled within one week of placement. Such items are clearly marked.

Mattresses can only be returned if they are unopened. Mattresses which have been opened and slept on cannot be returned. If you wish to test a mattress please keep it wrapped until you are sure you want to keep it.

Damage
Customers must report any damage i.e. scratches, dents, chips, tears, soiling etc. immediately upon delivery. It is important that each item is carefully and thoroughly inspected by you or your authorised agent immediately upon delivery. Please note that you must report any damage immediately upon delivery by noting it on the Delivery Collection Note. Beechlawn Furniture Ltd will not be responsible for any damage not reported.

Colour Variation
Whilst every reasonable effort will be made to ensure colour matches, fabrics and leather may vary due to dye lot variations. Leather and wood products will by their nature be subject to grain variations. Beechlawn Furniture Ltd will not be responsible for colour variations in the event that matching items are not purchased together.

Information and Specifications
All descriptive matter, drawings, pictures, colours, specifications and advertising on the Website are for the sole purpose of giving an approximate description of the Products.

Returns
When you purchase online, you have a statutory right to return a product up to 7 days after your order has been delivered (cooling off period). All items returned to Beechlawn Furniture Ltd must be in there original packaging and returned in same conditions as they were delivered. You can return the item to us and we will organise a refund (excluding delivery cost) Please contact our customer care support for a quote on return delivery. If an item is damaged or faulty please contact us and we will organise a replacement or refund.

Special Customised Orders
The above 7 day return (cooling off period) does not apply to Special Customised Orders.

Ready to Assemble Items
Beechlawn Furniture Ltd will not accept the return of any item which has undergone any assembly by the purchaser. All items returned to Beechlawn Furniture Ltd must be in there original packaging and returned in same conditions as they were delivered.

Warranties and liability
All goods supplied by the Beechlawn Furniture Ltd come with a manufacturer’s warranty of at least 12 months.

Beechlawn Furniture Ltd shall provide the Buyer with such information as is required to claim under the manufacturer’s warranties. In the event of a claim, the Buyer shall in the first instance email Beechlawn Furniture Ltd customer service department service@beechlawnfurniture.com

Beechlawn Furniture Ltd does not provide any warranty cover against defects in his own right.

Except where the Buyer acts as a Consumer all other warranties, conditions and terms relating to fitness for purpose, satisfactory quality or conditions of the products whether implied by statute or common law or otherwise are excluded to the fullest extent of the law.

Insofar as is permitted by law, our only liability to you under these terms and conditions will be, at our sole discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received by you in a damaged or defective state or to refund to you any sums actually paid by you for the goods in question. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us and will have no liability to you for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond our reasonable control. Nothing in this Clause 5 affects your statutory rights as a consumer.

Title and risk
Risk of damage to or loss of the Products shall pass to the Buyer upon delivery.

Notwithstanding any other provision herein title in the Products shall not pass to the Buyer until the Seller has received in cash or clear funds payment in full.

The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Products which remain the property of Beechlawn Furniture Ltd, but if the Buyer does so all moneys owing to Beechlawn Furniture Ltd shall (without prejudice to any other right or remedy on the Beechlawn Furniture Ltd) immediately become due and payable.

Limitations of Liability
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed £200.00.

Modification of Terms
We reserve the right to change the terms of use or policies regarding the use of the Website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the terms of use on the Website.

General
We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident. Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. The section titles in the terms of use are solely used for the convenience of the parties and have no legal or contractual significance.

Proper law of contract
This Contract shall be governed by the law of Northern Ireland and any dispute, question or remedy howsoever arising determined exclusively by the Court of Northern Ireland.

Termination
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions.
